Agreement to Terms
These Terms & Conditions ("Terms") govern your access to and use of the Wardrobe AI – Virtual Try-On mobile application (the "App").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not download or use the App. These Terms should be read together with our Privacy Policy, which explains how we collect and use your information.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement.
Description of Service
The App is an AI-powered fashion companion that allows you to:
- Upload or capture personal photos to create an avatar
- Virtually try on clothing items using AI-powered rendering (via our third-party try-on provider)
- Receive AI-generated style suggestions and outfit compatibility scores
- Use AI-powered image upscaling and background removal on uploaded photos
- Interact with Wardrobe AI using typed or spoken (speech-to-text) queries
- Browse curated, country-organized third-party brand listings via in-app web views
- Organize a digital wardrobe/closet and save outfit combinations
The App is provided "as is" and "as available." We do not guarantee that any specific feature will always be available, error-free, or uninterrupted.
Eligibility and Accounts
The App currently does not require account registration or sign-up. Certain features (e.g., cloud sync, if enabled) may be tied to your device or, in the future, an account you create. If account functionality is introduced, you are responsible for maintaining the confidentiality of any credentials and for all activity that occurs under them.
You represent that all information you provide to the App (including photos and preferences) is your own or that you have the right to use it.
License and Acceptable Use
License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-supported devices that you own or control, solely for your personal, non-commercial use.
Restrictions
You agree that you will not:
- Copy, modify, distribute, sell, or lease any part of the App, or reverse-engineer or attempt to extract its source code, except where such restriction is prohibited by applicable law
- Upload photos of any person other than yourself without that person's explicit consent
- Upload photos of any individual under the age of 18 other than yourself if you are a minor using the App with appropriate parental/guardian consent
- Use the App to create, upload, or generate content that is unlawful, defamatory, obscene, pornographic, harassing, hateful, or infringes on the rights (including intellectual property or privacy rights) of any third party
- Use the App's virtual try-on, upscaling, or background removal tools to create misleading, deceptive, or impersonating imagery of real individuals without their consent
- Attempt to use Wardrobe AI to generate harmful, illegal, or abusive content, or attempt to manipulate it into bypassing its intended safety behavior
- Use automated means (bots, scrapers) to access or interact with the App
- Interfere with, disrupt, or attempt to gain unauthorized access to the App, its servers, or related systems
- Use the App in any way that violates Apple's App Store Review Guidelines or Terms of Service
Your Content
You retain ownership of the personal photos and content you upload ("Your Content"). By uploading Your Content, you grant us a limited, worldwide, royalty-free license to use, process, store, and transmit Your Content solely for the purpose of providing the App's features to you (e.g., generating a try-on preview, style score, or upscaled image), as described in our Privacy Policy.
We do not claim ownership over Your Content and do not use it to train publicly-facing AI models without additional, explicit consent, unless otherwise disclosed.
You are solely responsible for Your Content and for ensuring you have the necessary rights to upload it.
AI-Generated Content Disclaimer
The App uses artificial intelligence to generate virtual try-on previews, styling suggestions, outfit scores, upscaled images, background-removed images, and responses. By using these features, you acknowledge and agree that:
- All AI-generated outputs are provided for inspiration and guidance only and do not constitute professional fashion, styling, medical, psychological, or other advice.
- Try-on previews are simulations. Actual fit, size, color, fabric, and appearance of any clothing item in real life may differ materially from what is shown in the App.
- AI styling scores and recommendations evaluate the outfit shown, not the user, and should not be interpreted as a judgment of your appearance, body, or personal worth.
- Responses (whether generated from typed or spoken input) are automatically generated and may occasionally be inaccurate, incomplete, or contextually inappropriate. Do not rely on responses for decisions with legal, financial, health, or safety implications.
- We do not guarantee the accuracy, realism, completeness, or reliability of any AI-generated output, and we are not liable for purchasing decisions, disappointment, or other consequences resulting from reliance on such output.
Intellectual Property
The App, including its design, features, graphics, trademarks, logos, and underlying software (excluding Your Content), is owned by the app or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Nothing in these Terms grants you any right to use our trademarks, brand names, or logos without our prior written consent.
Brand names, logos, and clothing content displayed through the in-app Brand List/WebView feature remain the property of their respective third-party brand owners.
We do not claim ownership of any third-party brand content displayed within the App.
Third-Party Services
The App integrates with or links to third-party services, including but not limited to:
- Fitroom API (virtual try-on rendering)
- Image processing providers (upscaling, background removal)
- Analytics and crash-reporting providers
- Third-party brand websites accessible via in-app WebView
These third-party services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, content, or practices of any third-party service, and your use of such services is at your own risk. If a third-party service becomes unavailable or is discontinued, related App features may be limited or unavailable without notice.
Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
We do not warrant the accuracy, completeness, or reliability of any AI-generated content, styling advice, outfit scores, or AI responses. Your reliance on any such output is at your own risk.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
Limitation of Liability
To the maximum extent permitted by applicable law, Wardrobe AI, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the App; including but not limited to reliance on AI-generated try-on previews, styling suggestions, outfit scores, or AI responses.
Our total aggregate liability for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim, or USDs applicable, whichever is greater.
Nothing in these Terms limits liability for gross negligence, willful misconduct, or matters that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold harmless Wardrobe AI, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of: (a) your violation of these Terms; (b) Your Content, including any photos you upload without proper consent; or (c) your misuse of the App's AI features.
Termination
We may suspend or terminate your access to the App, without notice, if we believe you have violated these Terms, engaged in unlawful conduct, or misused AI-generated features.
You may stop using the App and delete it from your device at any time. Upon termination, the license granted to you ends immediately, and any provisions of these Terms that by their nature should survive termination will continue to apply.
Changes to the App and These Terms
We may update, modify, or discontinue the App or any of its features (including AI-powered features) at any time, with or without notice. We may also revise these Terms from time to time; material changes will be reflected by updating the "Last Updated" date above and, where appropriate, an in-app notice. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence (e.g., EU/UK or California) provide otherwise and cannot be waived.
Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved informally by contacting us at [email protected]. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts of Abu Dhabi, United Arab Emirates, unless otherwise required by applicable local law.
- Apple-Specific Terms
Because the App is distributed via the Apple App Store, the following additional terms apply:
- These Terms are between you and Wardrobe AI only, not with Apple Inc. Apple is not a party to these Terms and has no obligation to provide maintenance or support for the App.
- Apple has no warranty obligation with respect to the App, except, where applicable, to refund the purchase price.
- Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal requirements, or claims under consumer protection law.
- Apple is a third-party beneficiary of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
- You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
